GO TO ISTRIA is a web page that helps Users research and book tours and post opinions of those experiences. All bookings are made through Go To Istria (Go 2 Istria Tours d.o.o.), a Limited Liability company based in Pula, Croatia.

Only when Go To Istria (Go 2 Istria Tours d.o.o.) has received part or full payment from the participant, will there exist a contract between both parties.

Please carefully read the General Terms and Conditions before purchasing any of the services provided on this webpage gotoistria.com (from now on: the Webpage). Use of the Website means you have read, understood, and agreed to be bound by all parts of the General Terms and Conditions and the Privacy Policy. If you do not agree with these Terms of Use, you cannot access or use the services.

This Webpage (including sub-sites and text, images, videos, software, products, services, and other information contained in or presented on the Website) is provided and owned by Go 2 Istria Tours d.o.o.

While Go 2 Istria Tours d.o.o. tries to ensure that the information on the Website is accurate, it does not provide any warranties, express or implied, about its correctness, completeness, or suitability for any purpose.

Go 2 Istria Tours d.o.o. may change, add, or remove information on the Website and its structure and functions at any time at its sole discretion, without expressly informing of any such change, and without removing outdated information or characterizing it as such. Go 2 Istria Tours d.o.o. may also block Users from accessing the Website or parts of it or require certain conditions to be fulfilled. Go 2 Istria Tours d.o.o. does not provide any warranties, express or implied, about the Website’s availability or its functions, that the Website is free from defects, or that the Website and the infrastructure on which it runs are free from viruses and other harmful software.

Go 2 Istria Tours d.o.o. excludes its liability and its agents and independent contractors, their employees, officers, sub-agents, or distribution partners for damages relating to your access (or inability to access) to the Website. Any errors or omissions, or the results obtained from the use, of the Website, whatever the legal basis of such liability would be, except liability for damages caused willfully or through gross negligence, and only to the extent permitted by applicable law. Restrictions of liability do not apply within the scope of guarantees issued, in the event of an injury to life, limb, or health, or for claims based on product liability regulation.

Go 2 Istria Tours d.o.o. may amend these Terms of Use with immediate effect. If we make amendments, they apply as their publication on the Website.

Cancellation Policy

The provider of the services needs to be notified about the cancellation by email or telephone.

When the booked services are cancelled by the client, the client is entitled to a refund according to the following schedule:

  • Cancellation up to 24 hours before arrival – 100%
  • Cancellation 0-24h before arrival – 0%

In case of delay or non-arrival by the client at the agreed time, the service provider is not obliged to perform the confirmed service nor return the money. If the customer decides to terminate or abandon the paid service at any time, the service provider is not obliged to return the money.

Cancellation by Go 2 Istria Tours d.o.o. – In case of cancellation before arrival, Go 2 Istria Tours d.o.o. will notify the client as soon as possible. In this case, the client has the option to accept a new schedule or receive a full refund for the service/trip. Itineraries are subject to change depending on weather conditions or other unpredictable events. Go 2 Istria Tours d.o.o. is not responsible for weather conditions that may adversely affect the activity.

Clients have the right to file a complaint about Go 2 Istria Tours d.o.o. property for the first 15 minutes after the start of the service. All complaints outside the 15-minute timeframe will not be accepted, and all costs will be borne by the customer.

Insurance

No previous experience is required for the purchase of our services. Participants are solely responsible for being in adequate health and physical condition to participate in our services, and to have the necessary basic level of fitness corresponding to the reserved activity. Each activity has an indicated planned time of activity and rest time.

Clients are required to be able to swim and behave appropriately at sea if they attend our water services or excursions which include swimming.

All clients participate in our services at their own risk.

Go 2 Istria Tours d.o.o. provides basic insurance against third parties in the event of accidents or injuries during the execution of our services.

Clients are advised to have additional insurance in case of accidents or injuries.

Limitations of Liability

You agree that Go 2 Istria Tours d.o.o.’s entire liability, and your exclusive remedy, with respect to any service(s) provided under this Agreement and any breach of this Agreement is solely limited to the amount you paid for such service(s).

Go 2 Istria Tours d.o.o. shall not be liable for any direct, indirect, incidental, special, or consequential damages resulting from the use or inability to use any of its services or for the cost of procurement of substitute services. Go 2 Istria Tours d.o.o. is not liable for bodily injury, accidental death, or property damage or theft as a result of (but not limited to): falling, physical exertion for which a guest is not prepared; forces of nature; travel by foot or other forms of active or adventure travel; consumption of alcoholic beverages; civil unrest; terrorism; a breakdown of equipment; high altitude; lack of or limited access to medical attention in remote locations; and the adequacy of medical attention once provided. Travel insurance is strongly recommended.

Go to 2 Istria Tours d.o.o. is not liable for additional expenses a guest may incur as a result of a late start and/or late return due to natural disasters, weather, traffic, illness of a guide, or other guests while en route, or any other delays due to circumstances beyond the control of Go 2 Istria Tours d.o.o. Go 2 Istria Tours d.o.o. reserves the right to make a route, modifications as necessary to improve the trip’s quality or to accommodate weather and the comfort and well-being of guests. Guests of Go 2 Istria Tours d.o.o. give express permission to take photographs or video recordings of its trips for marketing purposes, as well as approving such use by third parties with whom Go 2 Istria Tours d.o.o. may collaborate with, without financial remuneration.

Payments on the Website

To use the payment functions of Go 2 Istria Tours d.o.o., the User has to register. The User has to enter correct payment information and update the details immediately in changes.

Upon the payment authorization, the User consents to their payment information being used to collect payments by the creditor.

Pricing of Go 2 Istria Tours d.o.o.

All prices on Go 2 Istria Tours d.o.o. are quoted per person and include VAT and all other taxes. All prices are shown in EUR and it will be charged in EUR.

Following Consumer Protection Act, Article 79 (Zakon o zaštiti potrošača), the User shall have the right to inform Go 2 Istria Tours d.o.o. of their decision. The consumer has the right, without stating reasons, to unilaterally terminate the contract concluded on this Website from the day of its conclusion, no later than within 14 days.

In the case of a sales contract, the withdrawal period (14 days) shall start:

  • the day on which the User is in possession of the goods.
  • in case of multiple goods ordered by the User, the day on which the User
  • in the case of concluding contracts subject to digital content not supplied on a physical data carrier, the deadline referred of 14 days shall begin to run from the day of concluding the contract

In the case of service contracts, the withdrawal period shall start on the day of the conclusion of the contract.

The Users shall inform Go 2 Istria Tours d.o.o. of their decision to withdraw from the contract by making an unequivocal unilaterally terminate the contract (sent by email) setting out their decision to withdraw from the contract and state their name, surname, address, and telephone number and email. The User shall be deemed to have delivered the withdrawal statement when the User sends it within the time limit for withdrawal from the contract.

In the event of withdrawal, Go 2 Istria Tours d.o.o. shall immediately, or not later than 14 days from the day on which it receives the User’s decision to withdraw from the contract, reimburse all payments received from the User. Go 2 Istria Tours d.o.o. shall carry out the reimbursement using the same means of payment as the consumer used for the initial transaction unless the User has expressly requested the use of other standards and provided that the User does not incur any fees as a result of such reimbursement.

Availability and Warranty

There is no claim for availability, quality or service features, or technical support for the Website. Go 2 Istria Tours d.o.o. can redesign, reduce, or suspend its online portal at any time, at its discretion.

Waiver

RELEASE OF LIABILITY, WAIVER OF CLAIMS, INDEMNITY AGREEMENT & ASSUMPTION OF RISKS. READ CAREFULLY! 

Each person in a group must submit one of these forms. 

If the person is under the age of 18 then a parent or guardian must sign their form and assume responsibility for the minor.

ASSUMPTION OF RISKS

I am aware that activities such as sea kayaking, snorkeling and beach hiking takes place on the Adriatic sea and involves certain risks that cannot be avoided and must be understood as a condition of my participation with Go To Istria (brand by Go 2 Istria Tours d.o.o.)

The risks are unmarked and include, but are not limited to, the following: variable & inclement weather, cold water exposure, waves, surf, surf landing & launches, current, capsizing, drowning, hypothermia, collision with other watercraft, slipping, falling, injuries related to poor trail conditions and maintenance and injuries from carrying kayaks, burns from hot fires and hot objects and wildlife encounters. Participants may become lost or separated from their party. Rescue and medical treatment may not be readily available. I am aware that Go To Istria may call upon third party boat operators and water taxis for assistance. The conditions for boarding motorized vessels may occur in rough sea conditions or on or near rocks and beaches; it is possible to be injured while boarding, traveling and off-loading motorized vessels. This is only a partial list of risks, dangers and hazards which may be encountered at any time, and could potentially cause injury or death.

In order to participate in the “Activities” with Go To Istria I hereby agree as follows:

  • I AM AWARE OF THE RISKS, ASSOCIATED WITH PARTICIPATION IN A SEA KAYAKING TOUR / RENTING WITH GO TO ISTRIA. I FREELY ACCEPT AND FULLY ASSUME ALL SUCH   RISKS AND THE POSSIBILITY OF PERSONAL INJURY, DEATH, PROPERTY LOSS OR DAMAGE RESULTING THEREFROM.
     
  • By my participation in these activities and/ or use of equipment, I hereby assume all risks and dangers and all responsibilities for any loses and/ or damages, whether caused in whole or in part by the negligence or other conduct of the owners, agents, officers, or employees of Go To Istria, or by any other person including myself.

     

  • I verify that I am in good health, not under the influence of any drugs or alcohol of any kind, nor do I have them in my possession,, and am capable of pursuing paddle sports, and that my participation in this activity is voluntary. I acknowledge that I do not have any physical limitations, medical ailments, physical or mental disabilities that would limit or prevent me from participating.

     

  • TO WAIVE ANY & ALL CLAIMS that I have or in the future have against Go To Istria, its owners, officers, directors, employees, members, agents, assigns, legal representatives, successors, independent contractors, and all associates involved in the “Activities” (the “Releasees”). This includes acts of gross negligence and negligence by the Releasees including but not limited to the Releasees failing to predict dangerous conditions as well as failing to respond to an emergency in accordance with their certifications.

     

  • TO RELEASE and DISCHARGE THE RELEASEES from any and all liability for any loss, damage, expense or injury, including death that I may suffer or that my next of kin may suffer as a result of my participation in the “Activities” with Go To Istria. Including: NEGLIGENCE, BREACH OF CONTRACT, OR BREACH OF ANY STATUTORY OR OTHER DUTY OF CARE AND ALSO THE FAILURE ON THE PART OF THE RELEASEES TO PROTECT ME FROM THE RISKS ASSOCIATED WITH MY SEA KAYAK TOUR.

  • I, on behalf of myself, my personal representatives and my heirs, hereby voluntarily agree to release, discharge, hold harmless, defend and indemnify Go To Istria and its owners, officers, and employees from any and all claims, actions or losses for bodily injury, property damage, wrongful death, loss of services or otherwise which may arise out of my use of paddle sport equipment or premises or my participation in paddle sport activities.I specifically understand that I am releasing, discharging, and waiving any claims or actions that I may have at present time or in the future for the negligent acts or other conduct by the owners, agents, officers or employees of Go To Istria.

  • FOR GUARDIANS: I have the legal authority to act as a guardian for the below named minor(s). I am aware the minor(s) will be participating in a sea kayak tour or rental with Go To Istria and that minors may not be contractually bound by a Release of All Claims and Waiver of Liability Agreement which I have seen and I have signed. I therefore specifically agree to indemnify and hold harmless Go To Istria gainst any and all claims, actions and suits that may be instituted by the above noted minor(s) that is under my care prior to, during and after the “Activities” with Go To Istria.

     

  • I CONFIRM THAT I AM THE LEGAL AGE AND I HAVE READ AND UNDERSTAND THIS AGREEMENT, AND I AM AWARE THAT BY SIGNING THIS AGREEMENT I AM WAIVING CERTAIN LEGAL RIGHTS WHICH I OR MY HEIRS, NEXT OF KIN, EXECUTORS, ADMINISTRATORS AND ASSIGNS MAY HAVE AGAINST THE RELEASEE(S).

This agreement and any rights, duties, and obligations between the parties of this agreement shall be governed in accordance with the laws of Croatia.
